1. Who we are and what we do
[Legal entity name] (“LPNET”, “we”) is a motor vehicle transport broker. We arrange transport; we do not move vehicles ourselves. A separate, independent motor carrier performs the physical transport. Our MC number is [MC number] and our USDOT number is [USDOT number].
By requesting a quote, booking a shipment or using this site you agree to these terms. If you do not agree, do not book.
2. Quotes are estimates until a booking says otherwise
- The online quote is an estimate from road miles, the vehicle details you give, the trailer type, the date and our current rates. It is not an offer that binds either side.
- A price is firm only when your booking confirmation states it. The confirmation controls over anything on this site.
- The price can change if what you told us was wrong or changes: a vehicle that does not run, a different size or number of vehicles, a changed address, or a different date.
- Pickup and delivery dates are windows and estimates, not guarantees, unless the confirmation says otherwise in writing. Weather, traffic, breakdowns, hours-of-service rules and other loads on the truck can move them.
3. Booking and payment
LPNET arranges the transport and the carrier performs it. How the price is split between a booking amount and a balance is set per booking and is written on your booking confirmation before you commit.
- A booking deposit may be taken to hold your place. Its amount, whether it is refundable, and when it becomes non-refundable are stated on your booking confirmation.
- Any remaining balance is due at delivery or as the confirmation states. The confirmation says who is paid, and which methods the carrier accepts (many accept certified funds or cash on delivery).
- Accepted methods: [Accepted payment methods: set in the CMS]
[Owner: the deposit amount, refundability and who collects the balance have not been confirmed. Replace this section with the final model.]
4. Changes and cancellation
- You can ask to change or cancel at any time. Tell us in writing (email is fine).
- Before a carrier is dispatched: [cancellation terms before dispatch: owner to set, for example full or partial refund of the deposit].
- After a carrier is dispatched: [cancellation terms after dispatch: owner to set, for example a dispatch fee or forfeited deposit]. The carrier may have turned down other work for your vehicle.
- If the driver arrives and the vehicle is not ready (does not run when you said it did, keys missing, nobody present), the load can be cancelled and a trip charge can apply.
- We can cancel or reassign a load if a carrier falls through, if information is wrong, or for safety. If we cancel and have not moved your vehicle, we refund what you paid us for that shipment.
5. Your responsibilities
- Give accurate information about the vehicle, its condition, and both addresses.
- Be at pickup and delivery yourself, or name an adult who can inspect the vehicle and sign for you. Anyone who signs the bill of lading signs on your behalf.
- Remove personal items and toll tags. Carriers’ cargo insurance generally does not cover contents, and the vehicle may be loaded with other vehicles around it. Illegal goods, weapons and hazardous materials may not be shipped inside a vehicle.
- Leave no more than a quarter tank of fuel, and tell the driver about anything unusual (alarm, kill switch, low clearance, modified suspension).
- Make sure you are the owner or authorised to ship the vehicle, and that it is not subject to a lien or legal hold that would prevent transport.
6. Pickup, delivery and the bill of lading
The driver and you inspect the vehicle at pickup and record its condition on the bill of lading (the shipping contract and condition report). At delivery you inspect against it. Note any new damage on the bill of lading before you sign for delivery, and photograph it. A bill of lading signed without notes is strong evidence that the vehicle arrived in the condition recorded.
If a large truck cannot safely or legally reach an address, the driver will propose a nearby meeting point. Refusing a safe meeting point can delay or cancel delivery.
7. Insurance and damage claims
- The assigned carrier’s cargo insurance covers the vehicle in transit, subject to that policy’s limits, deductible and exclusions. A broker’s surety bond is a different instrument and is not cargo insurance.
- We check that insurance is on file before dispatch. Ask us for the carrier’s certificate. We cannot promise that any policy will pay any claim.
- If there is damage, note it on the bill of lading at delivery, photograph it, and contact us the same day, with the bill of lading and photos. We help you file with the carrier and their insurer. [claim notice deadline: owner and counsel to set, for example 5 days from delivery].
- Claims for delay, loss of use, rental cars and similar indirect losses are limited as set out in section 9.
- Your own auto insurance may also respond. Check your policy.
8. Delays
We will tell you promptly when we learn that a pickup or delivery will be late. We are not liable for delays caused by events outside our reasonable control. If a delay is long, you can ask to cancel; section 4 applies.
9. Limits on our liability
To the extent the law allows, our liability for any claim about a shipment is limited to [limitation of liability: counsel to draft, for example the amount you paid LPNET for the shipment], and we are not liable for indirect or consequential losses. Nothing here limits liability that cannot legally be limited, and nothing here limits the carrier’s liability to you under federal law. Counsel must review this section before it is relied on.
10. Electronic signatures and records
You agree that electronic signatures on booking confirmations, bills of lading and other documents are valid, to the extent allowed by law (for example the federal E-SIGN Act). We keep a record of what was signed, when, and the signing details. We keep transaction records for the period described in the privacy policy.
11. Use of the site
Do not scrape, overload or probe the site, submit false information, or try to access staff areas. We can block abusive traffic. Site content is provided as is; we try to keep it accurate but do not warrant it is error-free.
12. Disputes and governing law
Please contact us first; most problems are solved by talking. [governing law, venue and whether disputes go to arbitration: counsel to specify].
13. Changes to these terms
We may update these terms. The version in force when you book governs that booking. The date at the top shows when this page was last drafted.
